The Independent National Electoral Commission, (INEC) has declared that it would comply with the court judgment, asking it to proceed with the process for the recall of Senator representing Kogi –west senatorial district, Dino Melaye.
A Federal High Court in Abuja had on Monday dismissed the application by Senator Dino Melaye challenging moves by the Independent National Electoral Commission (INEC) to affect his recall.
Justice Nnamdi Dimgba in his ruling held that all the complaints made by Melaye lacked merit and deserves to be dismissed.
Justice Dimgba ruled that the recall process is a political question, which is beyond the court to deal with. He said the constituents have no duty to serve the legislator a copy of the recall petition.
INEC in a statement signed by one of its Commissioners, Mohammed Haruna on Tuesday said it would release a revised timetable and schedule of activities for the recall next Monday.
The statement read in part: “It will be recalled that in obedience to an interlocutory order of the Federal High Court, Abuja given on 6th July, 2017 the Independent National Electoral Commission (INEC) stayed all actions relating to the petition to recall Senator Dino Melaye as the Senator representing Kogi West Senatorial District.
“Judgment in the suit was delivered yesterday, 11th September 2017. All legal hurdles have now been cleared and the recall process can now proceed as envisaged by the Constitution, the Electoral Act and the extant INEC guidelines and regulations.
“Accordingly, and in compliance with the orders of the Court, the Commission will release a revised timetable and schedule of activities on Monday 18th September 2017.”
