Olanipekun leads over 40 SANs to defend Onnoghen as CCT trial begins

Chief Wole Olanipekun (SAN) has arrived the Code Conduct Tribunal (CCT), in Abuja, where he is leading over 70 lawyers which include over 40 Senior Advocates of Nigeria (SAN), to defend the Chief Justice of Nigeria, Justice Walter Onnoghen.

Onnoghen is expected to be arraigned today (Monday) at the CCT on a six-count charge bordering principally on failure to declare his assets and operating a domiciliary account.

However, as of 10:00 am when the proceeding was to start, he was not yet seen at the Tribunal premises.

Some of the SANs already seated in court in defence of Onnoghen, awaiting the commencement of the CCT proceedings include, Wole Olanipekun, Kanu Agabi, Chief Chris Uche and Chief Adegboyega Awomolo.

They are to stand in for Onnoghen against other on the side of the prosecution, which are five lawyers led by Aliyu Umar SAN.

The executive secretary of the anti-corruption research data based initiative, Dennis Aghanya, had written a petition against the CJN Onnoghen, alleging amongst others things that the Onnoghen failed to declare ownership of sundry accounts funded through cash deposits made by himself up to August 10, 2016.

The CJN affair !- Barrister Olu Aluko
It does not look good on anybody and the country as a whole! The mere talk of arraignment of the chief justice of Nigeria is the height ! This is even not even about 150 lawyers ready to defend him ! Or whether the president is aware or not! It just now shows the extent corruption or the suspicion of Corruption has reached!
Indeed “Houston we have a big problem !!!
Lets face it, its not possible for Corruption to reach the level it has reached in our society without the judiciary been actively involved ,
It is unfortunate that as in all high profile cases there is always a political interpretation to things ! And the reason for this is becausein most times Things appear skewed when corruption has been attempted to be fought in this country ! The perception of the fight and justifiably so is that the fight appears motivated by reasons other than the genuine fight on corruption !
In a clime where the institutions are inherently weak the fight is now left to the whims and caprices of individuals ! This fight can only be geniunely fought by strong institutions,!
For instance and in this very instance you would have thought the first port of call should have been the NJC ,the institution responsible for first inquiring into such matters like this one!
Ordinarily what should concern the president! He is not a policeman, neither the efcc boss nor the head of NJC ! In other civilised climes what concerns a president with the fact that a man is suspected of having unexplained wealth!
Ironically it was the same supreme Court headed by this same CJ that recently passed a judgement which in essence ment a person accused of financial impropriaty had to prove or explain the sources of his wealth in reality it seems the chicken has come home to roost!i
What complicates this matter the timing of the move against the CJ! With elections looming there is the underliyng feeling that this govt does not trust the CJ and to make things worse the CJ is a southerner and the next in line if he falls may yet be another northerner!
You can now see when some of us had been shouting that Buhari’s anti Corruption program wore a skewed garb ,,this looming suspicion is the result!
Now all sorts of mischiefs can result from the move and even if the CJ has questions to answer it will always be obscured by polittics!
The thinking by interpreters is that if the coming presidential elections results ends in a court case can the president trust the current CJ to be in his corner ! And that if it appears he can’t trust him he is to be moved against!
This is the political interpretation to the move because of it’s timing,
Meanwhile what if the evidences against the CJ is compelling which is possible , What if in reality the CJ cannot justify the wealth he has, what if in truth he has not made material disclosure while filling his asset declaration forms?
We must decide collectively if we as a society is in truth willing to fight this corruption thing!
I know people ,especially lawyers will go to town quoting the Constitution and all sorts of law just to defend a colleague! But the truth is that pertinent question has this man aquired the wealth traced to him legitimately!
This is why I like countries like America where a vice president (Spiro Agnew) found himself in jail for tax evasion ! Nobody said it was politically motivated for when he was dodging tax it was him and him alone that was there!
It is time the society stop turning a blind eye to issues and try to mask things in politics!
This should be a learning curve for everybody particularly the Buhari administration as per the fight against corruption !
You cannot continue to shield your thieves !
It may well be that the CJN matter started from other quarters and caught the president unawares ! But will this story be believable to most Nigerians?
A further truth is that for a long time judgment could be purchased in this clime! And a clime where black market judgement can be obtained easily that clime can never have true Justice ! So while some are shouting foul in this current CJN brewing matter they should not turn arround and complain if we can’t find relatively sanity in our judicial process!
What should be a straight forward question is” is he guilty or not ” has now turned into another thing!

JUSTICE ONNOGHEN: A WORD FOR THE FACEBOOK LAWYERS

First, Onnoghen has not denied the weighty allegations against him.

He hasn’t said that those acts are no corrupt acts.

His only defence has been “ignorance” and “forgetfulness”.

He hasn’t even pleaded political witch haunt; you have been the one pleading it for him.

The head of the judiciary, which incidentally is what Onnoghen is, should be the first to inform Nigerians that ignorance is not an excuse in law.

You are here excusing the CJN. You are here adducing all the conspiracy theories, and pleading “political motivation” as though those make an obvious corrupt practice and infraction to become any less offense.

You are not even bothered about the curious humungous lodgements made in dollars, and the manner in which they were made? You never bothered that these could be payments for judgements bought? You never bothered that he chose not to mention those accounts and funds therein because he could not explain how he possibly could have made such staggering mind-numbing fortunes from his work and position?

You still wonder why we support PMB? He’s the only man that would never be swayed by your irresponsible wailing. He’s the only Nigerian that would not be cowed by your organised protests to forestall the right actions from taking place. You did it when Justice Ademola, Justice Ngwuta, Justice Ajumogobia and co were exposed; you took up arms, you shouted desecration of the judiciary and blew all those big big grammar, but today, we know what has happened to them. Some started collapsing in the dock.

If Justice Walter Onnoghen has a case to answer, and it does look like he has, brother, your shouting and wailing can never force PMB to intervene. Don’t forget that he has ear infections. Till date, the infections have not been cured, so he will hardly understand that you are even wailing.

Nigerian judiciary is smelling. If PMB does not back its clean-up and clensing, then we are doomed forever.

Let Justice Onnoghen face his problem.
If it’s politically motivated, let him tell court:

FACTS THAT SUGGEST BUHARI IS BEHIND THE GANG UP AGAINST THE CHIEF JUSTICE OF NIGERIA —

    1. The petition against the CJN was written by a group whose secretary, Dennis Aghanya, is a former media aide to Buhari and former CPC secretary when Buhari contested under CPC. He is also a founding member of the Buhari Organisation.

    2. The petition relates to the contents of Asset Declaration Form (CCB1). The Form is classified and not open to the public. It is therefore improbable for a third party to have assessed Onnoghen’s Form CCB1 without high profile conspiracy also involving Code of Conduct Bureau (CCB).

    3. The petition detailed Onnnoghen’s bank accounts with lodgements, dates and amounts. Banks do not disclose customers’ information to third parties except of course, security agents like DSS and EFCC. As it seems, the petitioner is only a front to mask the conspirators and make it look like a petition from non partisan NGO.

    4. CCB received the petition on January 9, filled express Charges on January 10. By January 11, the Code of Conduct Tribunal constituted Penal to try the CJN with express date of January 14 for arraignment. Just like that!

The practice as I know, is that when you forward a petition of this nature, it is assigned to a team for investigation. The petitioner is invited for questioning including taking of further information and written statements. Thereafter, the suspect is invited for questioning and his statement taken. The team then investigates all the assertions and writes a report based on its findings. It is based on the report and accompanying evidence that Charge is filed. How all of these processes took less than 24 hours in the CJN’s case is one of the wonders of APC.

    5. It is not possible for any NGO in Nigeria to have pulled this through in about 48 hours. Our Igbo elders say that behind every masquerade, there is a shrine. Only Aso Rock has the connection to mastermind such a script. In any case, it was poorly written and poorly acted. The case is dead on arrival. Even a law student knows the notorious law in this regard. How this escaped the masterminds, is one of the many incompetencies of APC. Ordinary small movie, they cannot perform without fundamental blunders. -Culled

  39. AnuOluwa Michael Adewele says

Balances in CJN Onnegen’s accounts, a civil servant!!!! WHERE DID HE GET THE FUNDS AND PDP IS DEFENDING HIM???

    The 3 main accounts are:

    Scb 00001062650. $164,804.82

    Scb 5001062686. £108,352.20

    Scb. 5001062650. $391,401.28

The CJN also ⚡FORGOT⚡ to list 55 houses!!! When Jonathan removed Justice Salami, democracy was not in danger. Anything Buhari does: “democracy is in danger”! Rubbish. A Forgetful CJN should honourably RESIGN. He may just forget to deliver justice approximately!

  40. Umar Ande says

How many did he led to depend Justice Salami when he was forced out office? Justice Onnoghen is given chance to depend himself before CCT, Justice Salami was not that lucky. Is it because Justice Onnoghen has fat accounts stacked with money while Justice Salami had none but clean name? It would take time before this country join those countries we love so much and aspiring to be like. No matter the efforts put in place to make this country be like Dubai, China, America or Britain corruption would stand in the way, with the support of the judiciary.
